1. Purpose and Generalities

The present general terms and conditions regulate products and services offered by Made of Genes, a registered trademark of MADE OF GENES, S.L., with CIF (VAT number) B-56766660, registered in the Mercantile Registry of Barcelona, in volume 49.071, folio 179, page B-606.615, inscription 1, with registered office in Carrer de la Riba, 36 Edifici Baronda, Espai A, 08950 Esplugues de Llobregat (Spain).

These Terms and Conditions apply to visitors of https://shop.madeofgenes.com/ or any of its pages, users who have downloaded the mobile application, users registered for information services, and clients who have hired services. You are referred to as "User" and agree to read and be bound by these General Conditions without variation.

2. Description and Nature of Made of Genes' Studies

Made of Genes offers Users the possibility of purchasing molecular studies for evaluation and improvement of health. These studies use molecular techniques such as DNA sequencing, genotyping, gene expression evaluation, metabolic profiles, epigenetic or metagenomic analysis.

Made of Genes' studies are not of a clinical nature and have not been designed for diagnosing or treating diseases. They function as digital tools to integrate variables and provide recommendations for healthy habits according to current scientific knowledge. Healthcare professionals may refer users to doctors for additional diagnostic tests.

Studies are designed for people over 18 with no serious pre-existing conditions, with legal capacity and under healthcare professional supervision. If Made of Genes suspects collection of information from minors or legally incompetent persons without legal representative approval, that information will be immediately eliminated and services interrupted with no refund or compensation entitlement.

3. Obligations of the User

Users acknowledge that using information from the Website, Apps, or reports occurs under their risk and responsibility and must be supervised by a healthcare professional. Made of Genes is not responsible for the misuse or negative consequences from an inappropriate action or interpretation of the aforementioned information by the User.

If Made of Genes believes a User is engaging in illegal activities, breaching Terms and Conditions, or providing false information, the company reserves the right to block, temporarily suspend, or close the account without compensation, without prejudice to civil or criminal sanctions.

Made of Genes' digital services are based on the Genomcore FRONTDESK platform, developed and managed by Genomcore, S.L. Platform use implies acceptance of applicable End User terms and conditions.

• Illegal, fraudulent, invasive, discriminatory, violent, threatening, intimidating, or abusive activities
• Gambling, lotteries, bets, or explicit sexual content
• Patent, copyright, or intellectual property infringement
• Spam or mass unsolicited requests
• Preventing or limiting Website/App functioning
• Violating current legislation or people's freedom and rights

4. Made of Genes' Liability

Users acknowledge that although Made of Genes makes best efforts ensuring technical and factual accuracy, this information is general and indicative, not diagnostic. Made of Genes is not responsible for the decisions made by the User based on the information provided through the Website, nor for the damages caused to the User or any third parties due to actions that are based on the information obtained therein.

Services are not suitable for clinical diagnosis. Clinical interpretation must be based on data obtained through clinically validated techniques by laboratories under healthcare professional supervision. Made of Genes is not responsible for consequences from partial, misleading, or erroneous interpretations by persons lacking specific health science training.

Made of Genes is responsible for damages from malicious action. The company is not responsible for damages arising from: (i) interruptions, viruses, breakdowns, interferences, omissions, or disconnections from unrelated causes; (ii) delays or blockages due to Internet, electrical, or communication system issues; or (iii) illegitimate third-party actions beyond control.

Made of Genes commits to complying with personal data protection legislation, performing data protection impact assessments, and ensuring GDPR compliance through consultations, inspections, and audits.

5. Registration

Before hiring the Service, Users may be required to register on Made of Genes platforms. Individuals must be at least 18 years old with legal capacity to contract. After service provision, accounts can only be accessed by natural persons of legal age or their legal representatives.

During registration, Users must provide personal data for identification and communication. For personal data type and intended use information, refer to the Privacy Policy.

If Made of Genes believes provided information is inaccurate or violates Terms and Conditions provisions, it may limit, suspend, or terminate platform or service access using necessary technical measures.

6. Purchase and Service Request

Made of Genes' Service is sold only to individuals of 18 years or older with legal capacity in operating areas.

Service acquisition occurs via: (a) the online shop on the Website; or (b) through collaborating companies, groups, or professionals with distribution or collaboration agreements, receiving vouchers or coupons redeemable as stated in these Terms and Conditions.

7. Prices, Payment Method, Promotions and Billing

Most services require single payment including biological sample collection and analysis, results delivery, online platform access, and online healthcare professional consultation.

All Services must be paid in full at purchase time by credit or debit card via payment gateway.

After payment verification, Made of Genes sends information on electronic signature procedures for informed consent and biological sample delivery.

Service prices are expressed in euros (€), clearly shown in the online shop and order confirmation process. VAT or other taxes may apply.

Service nature, price, and conditions are subject to change based on promotional offers or collaboration agreements. Users receive clear notice of applicable conditions.

Promotional codes with special conditions must be redeemed at checkout, with conditions including validity, expiration date, and transferability. Made of Genes reserves the right to validate and withdraw codes if misuse is detected.

All online shop payments use secure payment gateways. Users guarantee card data validity and are liable for card use. Made of Genes cannot be held responsible for the fraudulent use of a credit card, requiring users to contact their bank.

Payment or purchase proof is sent to the registration email. In some cases, invoices are sent when orders complete. Invoice modification requests go to invoicing@madeofgenes.com. Invoices are issued in electronic format only.

8. Refunds and Right of Withdrawal

Due to sanitary measures, Made of Genes' health studies are non-refundable once the process of analysing your biological sample has begun. Users have withdrawal rights if: (1) they have not visited the collection centre; or (2) the sample collection kit has not been sent. Users receive full refunds if blood samples have not been collected or sample kits not dispatched.

For health coach consultations requested but not attended, no refunds occur if users do not provide at least one working day's notice. Consultations included in studies are never refunded if not held.

Gift vouchers are not refundable and valid for 6 months. Before expiration, users can request extensions for an additional 6 months. After 12 months, vouchers permanently expire.

9. Validity of the Referral

For some studies, Made of Genes sends referrals to collection centres for healthcare professionals to take blood samples. Users are expected to attend diligently. Under certain circumstances, if users have not attended the centre, Made of Genes may contact them to check for issues. If users still have not attended a few days before the 6-month limit, Made of Genes contacts them again about approaching expiration.

Users may request validity period extensions for an additional 6 months before expiration. After this additional period, users cannot extend further and the referral is forfeited with no refund entitlement.

10. Discount Codes and Gift Vouchers

Made of Genes offers promo code and gift voucher redemption possibilities resulting in discounts or special services. Validity and conditions are clearly displayed. Generally, Website-purchased gift vouchers are valid for 12 months from purchase date. Vouchers unused within 12 months are forfeited with no refund entitlement.

11. Informed Consent

Before Service provision, Made of Genes asks users to read these Terms and Conditions. Users may contact Made of Genes through provided channels for doubt resolution or cancel service requests.

Confirming understanding and acceptance of these Terms and Conditions without reservation, Made of Genes sends a copy and informed consent form for electronic signature via trusted third party authenticating consent according to Regulation (EU) 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services (EIDAS).

Personal data use and processing information, including health and genetic data, and protective measures are included in the consent form, which users must sign to authorize processing under data protection regulations.

After informed consent signing, users receive referrals to collaborating centres for biological sample collection or sample collection kits, depending on the chosen study. Collection centres may request additional consent forms for their service provision.

12. Biological Sample Collection

Made of Genes' molecular studies require biological sample collection and processing. Depending on the Service, blood or saliva samples are taken. Blood samples must be taken by healthcare professionals in accredited collection centres. Saliva samples use self-collection kits sent with necessary instructions and materials.

Made of Genes delegates biological sample analysis to accredited clinical laboratories with special agreements. Sample processing is entirely performed by external laboratories following their protocols. Users agree that samples are stored in laboratory facilities for reasonable periods to avoid reanalysis or reprocessing requests, with samples destroyed after analysis without further use.

Under certain circumstances, Made of Genes may require additional samples due to insufficient original sample quality or quantity without additional charges. However, if users requested at-home DNA kits and sample quality is insufficient due to not following collection instructions, Made of Genes may ask you to go to your nearest collection centre to take your sample or send you another kit for an extra charge.

13. Biological Sample Processing

Made of Genes' molecular studies store biological information from different sources for secure, private analysis at scale using expert algorithms, statistical techniques, and machine learning. This contextualizes user biological and health status, offering actionable recommendations on priority areas based on personal determinants.

Requesting services, users must authorize molecular tests including genetic and/or metabolic markers. Requesting services, users expressly authorize Made of Genes to digitize, store, and process medical data and subcontract qualified third-party service providers. After collection, samples are analyzed as described in each study on the Website.

Users must not consent to personal data processing under these Terms and Conditions and the Privacy Policy should refrain from contracting services.

14. Delivery of Results

Depending on contracted Service, users receive one or more health reports in digital or printed format. Whenever possible, original reports issued by clinical laboratories are also sent. Generally, results are delivered through Made of Genes Website or App.

If studies include hard copies or users add this option separately, printed copies are sent to addresses. Despite confidentiality agreement signatures with service providers and correspondence secrecy protection, printed reports sent by external courier services means their delivery diligence is beyond control.

Digital reports are delivered through Made of Genes channels protecting connections using 256-bit SSL-TLS encryption, guaranteeing communication confidentiality and integrity. If impossible, users receive encrypted, password-protected PDF or ZIP file links on platforms, with passwords communicated separately through usual channels.

Under certain circumstances, when studies are purchased through healthcare providers, Made of Genes sends reports to providers and delivery through their usual channels.

15. Health Coaching

Made of Genes' studies are designed for clarification and contextualisation by healthcare professionals. Health coaching services are offered either free or for additional fees (depending on Service) through specialist teams providing personalised advice and support.

After results delivery, users have 2 months to schedule health coach consultations. After this period, services terminate and another service must be paid for consultations. If users fail to attend scheduled appointments without 24-hour cancellation notice, services are deemed terminated.

If services are contracted through partners, said partners may offer health coaching, not managed by Made of Genes.

At Made of Genes, healthcare professional consultation is highly encouraged.

16. Content and Limitations of the Studies

Made of Genes' recommendations are developed and reviewed by expert teams in biomedicine, genetics, psychology, nutrition, and sport areas according to prestigious scientific journal information or current health guidelines and protocols. However, due to complexity and innovation, this knowledge evolves and changes, with new relevant research published.

Some recommendations are based on clinical laboratory reference ranges established for healthy people without relevant health conditions. If users have relevant medical histories, are pregnant, take medication, or have other conditions, recommendations may not reflect specific needs and must be contextualised by qualified healthcare professionals.

Users will not perform or allow actions detrimental to or reducing Made of Genes' industrial and intellectual property rights value or validity. Users shall not register nor apply to register brands, names, symbols, logos, charts, denominations, or other elements identical, similar, or additions to Made of Genes' property, or causing confusion. Users may not use industrial and intellectual property rights as corporate name, business name, or domain name components.

17. Intellectual and Industrial Property

Website or related Apps content (texts, photographs, graphics, images, icons, technology, software, links, audiovisual or sound content, graphic design, source codes), Reports and study content are subject to industrial and intellectual property rights and are Made of Genes' exclusive property or collaborators' authorized property.

These General Conditions do not grant Users industrial and intellectual property rights licenses except for express Made of Genes written authorizations. Authorized use is non-exclusive, non-transferable, and only during contractual relationship subsistence. Users acknowledge Made of Genes holds exclusive rights. Users shall not commit or permit acts impairing or depreciating rights value or validity. Users shall not register trademarks, names, symbols, logos, graphics, designations, or elements identical, similar, or additions causing confusion.

Users are prohibited from employing industrial and intellectual property rights as corporate name, trade name, or domain name components.

18. External Links

Websites or Apps may contain links to third parties and other Internet websites or resources. Made of Genes is responsible for Linked Sites content and services inasmuch as the company is aware of their illicitness and has not deactivated links with due diligence. Users considering Linked Sites with illegal or inappropriate content may notify Made of Genes.

19. Modifying or Changing Terms and Conditions

Made of Genes reserves rights to modify Website layout and content at any time without notice, including these Terms and Conditions, taking effect immediately after publication. Terms and Conditions are always easily accessible and highly visible on the Website. Users must read Terms and Conditions carefully before purchasing or authorizing Services.

Certain Services may contain specific or special personal data protection conditions prevailing over these Terms and Conditions. Users must be aware of these specific conditions.

20. Complaints, Claims and Information Requests

Users may request official complaint forms.

21. Nullity

If any Terms and Conditions provision is deemed unlawful, void, or unenforceable, that provision is deemed severable from these Terms and Conditions without affecting remaining provisions' validity and enforceability.

22. Law and Jurisdiction

These Terms and Conditions and service purchase contracts using the Website and App are governed by Spanish law. If Users have "consumer" status under the Spanish Consumer Act ("Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias"), Users may file claims with their area of residence Courts.

If Users are not "consumers" under this Act, disputes arising from or related to contracts or Terms and Conditions are subject to Barcelona Courts (Spain) jurisdiction.

23. Alternative Resolution of Consumer Disputes

Users are informed about the Online Dispute Resolution (ODR) platform existence of the European Commission.
